The gun industry is not above the law.

This bill is an attempt to STOP a single lawsuit through legislative action. The city of Gary, which has been devastated by gun violence, has filed suit against gun manufacturers and dealers in an attempt to hold them accountable for reckless and negligent practices.

The National Shooting Sports Foundation (NSSF) — the lobbying arm of the gun industry — is run by the heads of at least five major gun manufacturers being sued by the City of Gary for their alleged wrongdoings. It’s crystal clear that the NSSF is trying to use the Indiana state legislature to pass legislation to avoid having to answer for the wrongdoing the City of Gary has alleged they committed.

Instead of fighting the lawsuit in the courts, where they’ve lost multiple times, the gun industry's last-ditch effort is to turn to Indiana lawmakers to stop this case from going forward.

The gun industry already enjoys unfair special protections and HB 1235 is aimed at allowing them to keep their alleged wrongdoings from reaching a jury of Hoosiers, evade justice, and operate unchecked. Let’s be clear, this is not how our legislative and judicial systems should work.

As your constituent, I urge you to oppose HB 1235. This bill is an attempt to STOP a single lawsuit through legislative action, thereby violating the separation of powers and silencing Hoosiers.

The city of Gary, which has been devastated by gun violence, has been attempting to hold the gun industry accountable for their alleged reckless practices. Instead of fighting the lawsuit in the courts, where they’ve lost multiple times, the National Shooting Sports Federation (NSSF)— which is run by at least five defendants in Gary’s lawsuit — has now turned to Indiana lawmakers to stop this case from going forward.

And while this lawsuit alleges that irresponsible business practices have resulted in communities being flooded with trafficked firearms in Gary, this legislation would create a dangerous reality for all Americans. We need to make sure elected officials in Indiana — and everywhere — aren't able to upend the judicial system to protect the gun industry. Even the tobacco and opioid industries couldn’t influence their way out of facing liability in the courts.

Until gun industry accountability is ensured, negligent business practices can continue to fuel America’s gun violence epidemic.
