Washington, D.C., June 2, 2022 - Following President Biden’s remarks on recent mass shootings and the need for action on gun violence, Brady urges the Senate to pass common-sense legislation without delay. President Biden’s remarks emphasized the many, every day instances of gun violence in our country against the backdrop of the horrific mass shootings in Buffalo, New York, Uvalde, Texas, and Tulsa, Oklahoma this month, underscoring the need for comprehensive legislation that the Senate has so far failed to deliver.Brady President Kris Brown shared:
“Over 50,000 Americans have died from gun violence since the House of Representatives passed H.R.8 and H.R.1446 with a bipartisan vote over a year ago. Despite this and despite the fact that over 90 percent of Americans support expanding and strengthening Brady background checks, the Senate has yet to take up these bills.That failure is inexcusable and this inaction is not why millions of Americans took to the polls to elected gun violence prevention champions. They are letting down their constituents and endangering every American.President Biden’s remarks this evening are yet the latest example of his commitment to this issue. He has taken historic action to prevent gun violence via executive authority early in his Administration. Brady continues to urge him to go further and take additional actions such as declare gun violence a public health emergency and to create an Office Of Gun Violence Prevention to coordinate a whole-of-government response to this crisis, his using the power and visibility of his office tonight was a powerful statement to his commitment to this fight. One thing is clear, if the Senate fails yet again to stand up for American lives, we will need swift and decisive action from the White House to fill in where they fall short.”
About H.R. 8:The Bipartisan Background Check Act of 2021, H.R. 8, makes it unlawful to sell or transfer a firearm in any transaction without a Brady Background Check. This bill expands the current Brady Law to every sale or transfer in private sales, subject to the narrow exceptions. H.R. 8 was introduced by Rep. Mike Thompson (CA-5) on March 2, 2021 and passed by the House of Representatives by a bipartisan majority on March 11, 2021.About H.R. 1446:Introduced on March 2, 2021 by Rep. Jim Clyburn (SC-6), H.R. 1446 provides the background check system with additional time to make a final determination on a potential firearms purchaser before a licensed dealer can transfer a gun. This bill closes the so-called “Charleston loophole,” which is named for the 2015 mass shooting at the Emanuel African Methodist Episcopal (A.M.E.) Church in Charleston, S.C., because the shooter was able to acquire his gun before the FBI could complete his background check.Currently, federal law allows a “default proceed,” whereby a federally licensed firearm dealer (FFL) can transfer a gun to a customer if the federal background check is not completed within 3 business days of the background check request to the National Instant Criminal Background Check System (NICS).
