New rule will expand Brady Background Checks and close deadly loopholes.

Washington, D.C., August 31, 2023 – Today, the Biden-Harris administration announced a new Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) proposed rule that clarifies the definition of being “engaged in the business” of selling firearms. Last year, Brady, the author of the original Brady Background Check law, along with Giffords, released a memo urging ATF to provide clarity into who is engaged in the business of selling firearms under the changes made in the Bipartisan Safer Communities Act.

Brady will be releasing an analysis of the proposed rule in the coming days:

A clear definition will ensure that individuals selling firearms for profit will have to conduct background checks, getting us closer to universal background checks. This is especially true now that Congress updated the definition through the Bipartisan Safer Communities Act.
“Today, more than 1 in 5 gun sales in the U.S. are conducted without a background check, amounting to millions of guns per year ending up in the hands of people who aren’t allowed to buy them. This rule expands requirements for gun dealers to become licensed and conduct background checks, closing a massive loophole in our live-saving background checks system. It is past time to ensure that anyone who sells firearms for profits is required to be licensed and that their sales of firearms are subject to a Brady Background Check.
